This Privacy Policy explains how MarketFoundry LLC ("MarketFoundry," "we," "us," or "our") collects, uses, and protects information when you use Wend (the "Service"). Wend helps families record and preserve life stories as a private video archive. Because Wend handles recordings of real people and the memories they share, we treat this information with particular care.
1. Who is involved
A Wend account usually involves more than one person:
- The account holder (the "gifter"): the person — often an adult child or grandchild — who sets up the account, invites others, and is responsible for billing.
- The storyteller: the person whose life stories are recorded. They join through a single private link and do not need to create an account or password.
- Family members: people invited to view the archive and suggest stories.
This policy applies to all of them. Where a storyteller is recorded, the account holder is responsible for ensuring the storyteller understands and agrees to being recorded.
2. Information we collect
Account information
- Email address of the account holder and any invited family members (used for sign-in, invitations, and billing)
- A display name you choose (so stories and suggestions can be shown warmly, e.g. "from your daughter Sarah")
- Subscription status and plan
Storyteller information
- The storyteller's name (or what the family calls them), and optionally their relationship and birth year, as provided by the account holder
- The recordings, transcripts, and derived archive described in Section 3
Technical information
- IP address, browser and device type, and basic activity within the Service (for security and to keep sessions working)
Payment information
- We do not store full card numbers or security codes. Payments are processed by our payment providers, whose privacy policies apply to payment data. We receive confirmation of payment status and a customer identifier.
3. Recordings, transcripts, and the archive
The heart of the Service is the recorded conversation. When a storyteller takes part in a session:
- We capture audio and (unless audio-only is chosen) video of the session.
- The audio is transcribed into text.
- The recording and transcript are organized into a titled, chaptered, searchable archive, including summaries and an index of people, places, and themes mentioned.
These recordings and transcripts contain personal, sometimes deeply personal, information that the storyteller chooses to share. We treat them as private to the family account and never sell them, and never make them public.
4. How we use information
We use the information we collect to:
- Provide and operate the Service — record sessions, build and host the archive, and make it available to the family
- Guide the conversation through our AI interviewer and organize what's shared into the archive
- Authenticate access and keep sessions secure
- Process payments and manage subscriptions
- Send necessary emails (sign-in links, invitations, receipts, and notices that a new story has been added)
- Detect and prevent abuse or misuse
- Comply with legal obligations
We do not sell personal information, recordings, or transcripts to anyone.
5. AI and service providers
To deliver the Service, recordings and related data are processed by a small number of trusted providers, each bound by its own privacy terms:
- Speech-to-text and AI interviewing/summarizing: our speech-recognition and large-language-model providers process session audio and transcripts to transcribe the conversation, guide the interview, and create the archive.
- Voice: our text-to-speech provider produces the interviewer's spoken voice.
- Real-time connection: our live-video provider carries the session between the storyteller's device and our recording system.
- Hosting & storage: recordings and account data are stored on secured cloud infrastructure in the United States.
- Payments: our payment providers handle billing.
6. Consent and your control
Recording only happens with the storyteller's awareness and agreement:
- Before each session, the storyteller is shown a clear, plain-language explanation that the conversation will be recorded, and proceeds only by choosing to continue. We record that this consent was given.
- The storyteller is always in control during a session — they can skip a topic, change the subject, pause, or stop at any time.
- If a storyteller asks for something to be left out, it is removed from the readable archive. Removal genuinely scrubs that content from the archive the family sees.
Because laws on recording vary by location, the account holder is responsible for ensuring it is appropriate and lawful to record the storyteller in their jurisdiction.
7. Family access and sharing
- An archive is private by default. It is visible only to the account holder and to family members they specifically invite.
- Invited family members can watch the archive and suggest story ideas. They cannot change billing or remove the storyteller's content.
- We do not make any archive public, and we do not share archives outside the account except as described in this policy.
8. Storage and security
- Recordings and account data are stored on secured cloud infrastructure in the United States, in private storage that is not publicly accessible.
- Connections are encrypted in transit (HTTPS/TLS).
- Sign-in uses secure, single-purpose links and session tokens rather than stored passwords.
- We apply reasonable technical and organizational safeguards. However, no method of storage or transmission is perfectly secure, and we cannot guarantee absolute security.
9. Keeping and deleting your data
- While your plan is active, your archive is kept and continues to grow.
- If a plan lapses, we freeze and preserve the archive — we do not silently delete it. The stories already recorded remain safe; the archive simply stops growing until the plan is resumed.
- Export is always available, free. You can request a copy of your stories and archive at any time — they are yours.
- Deletion on request: you may ask us to delete an archive, specific recordings, or your account. We will honor deletion requests, subject to any short retention required for legal or backup purposes.
To export or delete, contact us at [email protected].
10. Minimum age
Wend is intended for adults and is built around preserving the life stories of older family members. We set a minimum storyteller age of 13, and the AI interviewer is not designed to conduct sessions alone with young children.
- We do not knowingly collect personal information, recordings, or voice from a child under 13.
- Where a younger family member appears in a session, it should only ever be alongside a consenting adult, never as the sole subject of an AI-guided interview.
- If you believe we have collected information from a child under 13, contact us and we will delete it.
11. Your rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you
- Correct information that is inaccurate
- Export your recordings and archive
- Request deletion of your account, an archive, or specific content
- Opt out of non-essential communications
To exercise any of these, email [email protected].
12. Changes and contact
We may update this policy from time to time. We will post the updated version and revise the effective date, and will notify you of material changes. If you have any questions, please reach out:
